1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Pet Portrait Co.("Pet Portrait," "we," "us," or "our"), with a registered mailing address available on request at hello@petportrait.io. By using our website, uploading a photo, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to place an order, and at least 16 to use the service. By using it, you represent that you meet these requirements and that the information you provide is accurate.
3. The service
Pet Portrait turns a photo you upload into an AI-generated, fine-art-style portrait of your pet. You can preview a portrait for free, then optionally purchase a high-resolution digital download or a printed product (poster, canvas, or framed print). Previews are for on-screen viewing only; the downloadable, full-resolution print-ready file and prints are available only with a purchase.
4. Your content and the rights you grant us
You keep ownership of the photos you upload. You represent and warrant that you own or have permission to use each photo, and that generating a portrait from it does not violate anyone's rights. By uploading, you grant us a limited, worldwide, royalty-free license to host, process, and send your photo to our AI provider, and to create, store, and deliver your portrait and any product you order. This license exists only to operate the service and ends when we delete your content as described in our Privacy Policy.
5. Acceptable use
You agree not to upload or request content that is unlawful, infringing, sexually explicit, violent or gory, hateful, or that depicts or involves minors inappropriately, and not to use the service to harass others, to impersonate, or to violate any law. We screen custom prompts for prohibited content and may refuse, remove, or cancel any generation or order that violates these Terms, without refund where abuse is involved.
6. Your portrait and intellectual property
Subject to your full payment, the portrait we generate for you is provided for your personal, non-commercial use, including printing it for yourself or as a gift. Our website, branding, styles, and software remain our property. Because portraits are produced by an AI model, rights in AI-generated images can be uncertain and vary by jurisdiction; we make no representation that an AI-generated portrait is protectable by copyright.
7. AI results — what to expect
Portraits are created by an automated AI model and are inherently variable and stylized. We work hard on likeness and quality, but we cannot guarantee a perfect or exact match to your photo, specific colors, or any particular result. Previews are an approximation; the printed product depends on the source image quality, the chosen size, and the production process. This is why we back every purchase with the guarantee in Section 10.
8. Orders, pricing, and payment
Prices are shown in US dollars and are charged at checkout. Payments are processed by Stripe; we never receive your full card details. We may offer promotional codes (such as a limited-time discount), which are subject to their own conditions and expiry dates, can't be combined unless stated, and may be withdrawn at any time. The price calculated by our server at checkout governs. You are responsible for any applicable taxes, and for any import duties or customs fees on international print orders.
9. Shipping and fulfillment
Digital downloads are delivered electronically via a secure link after purchase. Printed products are made to order and fulfilled by our print partner, Prodigi. We currently ship prints to the United States, Canada, United Kingdom, Australia, Ireland, New Zealand, France, Germany, the Netherlands, Spain, and Italy. Shipping is included in the print price. Production and delivery times are estimates and may vary; risk of loss passes to you on delivery to the carrier. Please make sure your shipping address is correct — we may not be able to change or refund an order already in production.
10. Satisfaction guarantee, refunds, and returns
Because each portrait is custom-made for you, items are not returnable in the ordinary course. Instead, we stand behind every order: if you're not happy with a purchased portrait or print, contact us within 30 days of delivery and we'll make it right — a free redo or a refund, at our discretion. To request this, email hello@petportrait.io with the email you used at checkout. This guarantee does not cover issues caused by an incorrect address you provided or by a low-quality source photo we flagged. Where you have non-waivable statutory rights (for example, certain consumer or distance-selling rights), nothing here limits them.
11. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that any AI result will meet your expectations.
12. Limitation of liability
To the fullest extent permitted by law, Pet Portrait will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service or an order is limited to the amount you paid us for the item giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold Pet Portrait harmless from claims arising out of content you upload or your misuse of the service or violation of these Terms, including any claim that a photo you uploaded infringed someone's rights.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, and the courts located there will have jurisdiction, except where mandatory local consumer-protection law provides otherwise. We encourage you to contact us first so we can try to resolve any issue informally.
15. Changes to these terms
We may update these Terms from time to time. We'll update the "Last updated" date above, and your continued use of the service after changes take effect means you accept them.
